Foundation Source Philanthropic Services Inc. (“Foundation Source” or “we”) is committed to your right to privacy and to keeping your Personal Information confidential. This Privacy Notice is to inform you of our information and dissemination practices and policy for the Foundation Source web site at www.foundationsource.com (the “Website”). This Privacy Notice does not apply to the practices of entities that Foundation Source does not own or control, or to individuals not under Foundation Source’s supervisory control. Information Provided to Foundation Source by You:

You may freely visit our Website anonymously and without being required to provide us with any Personal Information or to register.   However, certain requests do require that you provide us with some personally identifying information as more particularly described below. “Personal Information” is data that can be used to identify or contact you.  Please do not send confidential information to us directly through this Website, or by email to any of the contact email addresses listed on this Website.

We receive and store information when you submit an online form to us via the Website, use Foundation Source services or communicate with us by email. This information may include, among other things, your name, address, and email address, and is referred to in this Privacy Notice as “Visitor Information”. You also have the option of registering with the Website in order to get access to our proprietary content, and should you opt to register we will collect certain Personal Information.  In all cases, the Personal Information that we collect is used only for our internal purposes and is not shared with unaffiliated third parties, other than our vendors who are providing services to us.

Information Gathered Automatically:

When you visit our Website, we may collect and store the domain name from which you accessed our Website, the IP address of your computer (an IP address is the unique number that identifies a computer on the Internet), the type of Internet browser you are using, the date and time of access, the pages you visit during your stay, the forms you submit on the Website, and the search terms you used to find the Website. We may also collect and store information regarding whether you have received, opened or forwarded emails received by you from Foundation Source. This information is used only for our internal purposes and is not shared with unaffiliated third parties, other than our vendors who are providing services to us.

What is a cookie?

Cookies are small text files that are stored on your computer’s hard drive or in your Web browser memory to enable a system (or web site) to identify you for purposes of customizing the features of a web site, automating data entry functions, improving the functionality of a web site or regulating access to particular features.

How are cookies used by Foundation Source?

What cookies does Foundation Source use?

Foundation Source uses the following cookies for marketing and other purposes.

  • Foundation Source uses cookies provided by Google Analytics, which puts a cookie on the visitor’s machine in order to track their movements and some specific actions on the Website. This information is not personally identifiable and is only reported to us in non-identifiable, aggregate form.
  • Foundation Source uses a tool called Conversion Ruler, which uses cookies to track pages viewed, the search terms used to find our Website, what advertisements visitors clicked on to get to our Website, and the form submissions made by visitors on our Website. Data received directly from Conversion Ruler is not stored on our system on an individually identifiable basis, although we may use a vendor to match data from Conversion Ruler to individual visitors for purposes of certain types of marketing and other research.
  • Foundation Source uses a tool called Eloqua, which uses cookies to track pages viewed on the Website and form submissions made by visitors on the Website. Eloqua also uses small .gif files, which are tiny graphics files that function similarly to cookies, to track whether visitors have received, opened or forwarded emails received by them from Foundation Source. The data provided to us by Eloqua may be linked to personally identifiable Visitor Information provided to us by the visitor.
  • Foundation Source uses a tool called Visual Website Optimizer, which uses cookies to improve the functionality of our Website by allowing us to test changes to our Website. Foundation Source does not receive individually identifiable information from this tool. Visual Website Optimizer provides us only with anonymous, de-identified information regarding visitors’ movements on our Website.
  • Foundation Source uses cookies in remarketing, as described below in the Section titled “What is remarketing and how can I opt out?“.

We have provided the information below to assist you in opting out of many types of cookies, should you wish to do so.

What is remarketing and how can I opt out?

Have you ever visited a web site and then noticed ads for that same web site (or product you viewed) on other web sites? This is commonly referred to as remarketing. In remarketing, third party vendors, such as Google, use cookies to display their ads to internet visitors for products or services in which that visitor has already shown an interest through their browsing or searching history.

We may use certain remarketing tools provided by Google. These tools enable Google and its partners, through their use of cookies, to serve ads to our visitors for our products and services based on our visitors’ past visits to our Website. We may also use Remarketing Dynamic Ads, which uses the Teracent cookie.

HOW WE USE THE INFORMATION WE COLLECT:

Internal Usage:

We store, analyze and compile the Visitor Information we receive for administrative, data processing, marketing, customer service, sales, web design and archival purposes, and to communicate with you as permitted under this Privacy Notice. We also may use the information you provide to us to meet your requests.  Unless otherwise set forth in this Privacy Notice or as permitted by you, we will not sell, rent, trade, or otherwise disclose any Visitor Information that you transmit directly to us, to anyone outside of Foundation Source, its affiliates, subsidiaries, agents and including without limitation, contractors providing services to us (and only to the extent necessary for our contractors to provide those services).

Aggregate Information:

Foundation Source may share aggregated, anonymous statistical information about visitors to Foundation Source with our affiliates, subsidiaries, partners, and contractors providing services to us.

Disclosure of User Information:

You have a right to confidentiality and we will not disclose to anyone other than our employees, agents, subsidiaries, affiliates and contractors providing services to us (only to the extent necessary for our contractors to provide those services) any portion of the Visitor Information transmitted directly to Foundation Source, except in the following circumstances: (a) when you agree that we may give out such information; (b) when we are required by law or to comply with a subpoena, legal process, government request or any other legal obligation; or (c) to prevent, investigate, detect, or prosecute criminal offenses or attacks on the technical integrity of the Website or our network, or (d) to protect the rights, privacy, property, business, or safety of Foundation Source, its partners and employees or the visitors to the Website, or  (e) in connection with Foundation Source’s participation in certain corporate transactions as set forth below.

To discontinue all Marketing communications from Foundation Source, including email, phone calls and other direct communications, please see the process below described in the section entitled “How to Discontinue Direct Communications from Foundation Source”.

Corporate Transactions:

As we continue to develop our business, we may participate in certain corporate transactions such as mergers and acquisitions, and it is possible that another entity or person may acquire Foundation Source or the business assets comprising Foundation Source. In such cases, Visitor Information may be shared with the potential acquirer and/or other related parties and their representatives in connection with such corporate transactions.

This Website may contain links to third-party web sites that are not controlled by Foundation Source (“Linked Websites”). Please be aware that we provide links to Linked Websites as a service to our visitors, and that we are not responsible for the content, privacy policies or information collection practices of any other web site. Please note that the privacy policies and other policies of the Linked Websites may differ from those of Foundation Source. Should you decide to access such Linked Websites, you do so at your own risk. We encourage you to review and understand their privacy practices and all terms and conditions of agreement before providing them with any information. Foundation Source is not responsible for any such provisions, and expressly disclaims any and all liability related to such provisions and the Linked Websites.

Children:

Foundation Source is a commercial business web site and is neither designed nor intended to collect Personal Information from children under the age of sixteen. If a child under the age of 16 submits information to us through any part of the Website and Foundation Source becomes aware that the user submitting the information is under the age of 16, the information provided will be deleted promptly after it is discovered and not used for any purpose. If you are the parent or guardian of a child under 16 years of age and believe that they have disclosed personally identifiable information to us, please email us at and be sure to include in your message the same user name and password and/or email address that you believe your child submitted, if applicable.

Security:

We employ commercially reasonable technical safeguards to store and maintain Visitor Information to protect it from loss, misuse, alteration, or destruction by any unauthorized party. Please be aware, however, that the Website does not employ SSL or Secure Sockets Layer technology. However, if you access the Website using SSL, or if you use Foundation Source’s online portal in connection with the administrative of your private foundation, we will maintain a secure connection until such time as you click on a non-secure link.

No Liability for Acts of Third Parties:

Foundation Source will use reasonable efforts to safeguard the confidentiality of Visitor Information. Foundation Source has no liability for disclosure of Visitor Information due to errors in transmission or unauthorized acts of third parties including interception of email sent/transmitted to Foundation Source by the Client via the internet.

USE OF THE WEBSITE FROM OUTSIDE THE UNITED STATES:

We do not represent or warrant that the Website, or any part thereof, is appropriate or available for use in any particular geographic location outside of the United States. If you choose to access our Website, you do so on your own initiative and at your own risk, and are responsible for complying with all local laws, rules, and regulations applicable in your jurisdiction. Please note that the Website is hosted in the United States and is governed by United States law. If you are visiting the Website from outside the United States, please be aware that your information will be transferred to, stored and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. HOW TO DISCONTINUE DIRECT COMMUNICATIONS WITH FOUNDATION SOURCE:

You have the right at any time to discontinue direct communications (including phone calls, emails and other direct communications) from Foundation Source.

CHANGES TO THIS PRIVACY NOTICE; ADDITIONAL TERMS:

You understand and acknowledge that we may at any time modify this Privacy Notice, in whole or in part, by posting such modifications on this Website. It is your responsibility to periodically review this Website for such modifications, which you can determine by reviewing the Privacy Notice “Effective Date” listed below. Your continued use of this Website and any content, programs, information, services or materials provided through the Website will be subject, in all respects, to the Privacy Notice in force at the time of such use. In addition, if you are a client of Foundation Source with a valid Foundation Source Foundation Services Agreement, as amended from time to time, you are subject to the terms of your Foundation Source Agreement when using the Foundation Source services and programs, content, information and materials provided through this Website.

CALIFORNIA PRIVACY LEGISLATION:

The California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (CPRA) provide certain California residents who are natural persons (“California Residents”) with the additional rights described in this section (CCPA and CPRA referred to collectively as “California’s Privacy Legislation”).

For the purposes of this section, Personal Information shall include the categories of information included in the definition of “personal information” under California’s Privacy Legislation.

Under California’s Privacy Legislation, twice per year, California Residents have the right to know and see what Personal Information Foundation Source has collected about them over the past 12 months, including:

  • The categories of Personal Information collected;
  • The categories of sources from which the Personal Information has been collected;
  • The business or commercial purpose for collecting their Personal Information;
  • The categories of third parties with whom Foundation Source has shared their Personal Information; and
  • The specific pieces of Personal Information Foundation Source has collected about them.

Under California’s Privacy Legislation, California Residents also have the right to:

  1. Request that Foundation Source delete their Personal Information and to cause Foundation Source to direct its service providers to do the same; and
  2. View and make correction to the Personally Identifiable Information we hold, and
  3. Limit the sensitive personal information we collect; and
  4. Access the Personally Identifiable Information we collect and choose to opt-out from this collection; and
  5. Request that we provide you a copy of the Personally Identifiable Information we have on you; and
  6. Request that we disclose what Personally Identifiable Information is disclosed for a business purpose, or sold or shared, and to whom; and
  7. In regard to your Personally Identifiable Information, opt-out from the sale or sharing with third parties.

Please note that in regard to the right of “data deletion,” there are a number of exceptions, however, that include, without limitation, when the Personal Information is retained by Foundation Source or a third party to:

  • Complete transactions with the California Resident;
  • Provide the California Resident with services;
  • Perform under a contract with the California Resident;
  • Protect against security incidents, or malicious, deceptive, fraudulent or illegal activity;
  • Debug or fix errors in its systems, website or software;
  • Comply with a legal obligation
  • Use for internal purposes that are reasonably aligned with the expectations of the California Resident based on the California Resident’s relationship with Foundation Source; or
  • Use internally in a lawful manner that is compatible with the context in which the California Resident provided the information.

During the past 12 months, Foundation Source may have collected the following types of Personal Information about California Residents:

California Residents have the right not to be discriminated against for exercising any of their rights under California’s Privacy Legislation.

Foundation Source expects to respond to California Residents’ requests to see what Personal Information Foundation Source collects about them and to delete their Personal Information within 45 days of receiving the request. If Foundation Source requires more time, it will inform the requesting California Resident of the reason and extension period in writing.

To exercise their rights under California’s Privacy Legislation, California Residents can submit a request by completing and submitting this form.

EEA, SWITZERLAND AND UK USERS:

The following provisions applies only to users residing in the EEA, Switzerland and the UK.

Please note, in May of 2018 a new data privacy law known as the EU General Data Protection Regulation (“GDPR”) went into effect.  Pursuant to GDPR, we are required to provide those residing in the EEA, Switzerland and the UK (hereinafter, the “EU Users”) additional information and rights related to the Personal Information we collect about them. We summarize such information and rights below.

PURPOSE FOR INFORMATION COLLECTION:

As noted in this Privacy Notice, you may visit our Website without being required to provide us with any Personal Information.  However, should you decide to provide such information, the information we collect will be used to meet your requests, or to provide you with the applicable information or service requested, and as further described herein.

LEGAL GROUNDS FOR PROCESSING PERSONAL DATA:

Foundation Source will process Personal Information that we receive from EU Users on the ground that it is in our legitimate interest for the effective administration of the Website, or to fulfill and/or address your requests.

YOUR INFORMATION AND YOUR CHOICES; WITHDRAWAL OF CONSENT:

GDPR provides EU Users with additional rights with respect to the Personal Information we hold about you, including the right i) to be informed about the Personal Information we have collected, and ii) to request a copy of the Personal Information, and iii) to have your Personal Information deleted, and iv) to lodge a complaint about our processing of your Personal Information with your local supervisory authority.  Upon appropriate written request we will update or amend your Personal Information, but we reserve the right to use any information previously obtained to verify your identity or take other actions that we believe are appropriate and lawful. You may access, correct, withdraw your consent to our use of or, request deletion of your Personal Information – or request that we stop any processing of your Personal Information – by contacting us at the address listed above. We will respond to your request within a reasonable timeframe.

Please note we may need to retain certain information for record keeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed from such locations.  Additionally, there may be circumstances in which we are not legally required to comply with your request because of the laws in your jurisdiction or because of exemptions provided in data protection legislation in general, and GDPR in particular. Finally, please note that we are not responsible for removing or deleting information from the databases of third parties (such as service providers) with whom we have shared information about you, but we will make the request on your behalf for such removal/deletion.
